NOW, therefore, the following law is ordered and promulgated with respect to the regulation of laser-directed devices:ARTICLE I: IN GENERAL.§ 16-52. DefinitionsThe laser pointer or device means a device intended to amplify electromagnetic radiation by stimulated emission that emits a beam to be used by the operator as a pointer or highlighter to reach a certain position, display, mark or identify a specific location, object or object. 16-53. Illegal possession by minors; Exception. (a) It is unlawful for a minor to possess a laser pointer or laser device without being under the direct supervision of a parent, guardian or teacher whose parent, guardian or teacher assumes full responsibility for its possession and use under this article and bears all the consequences of its abuse. (b) Laser pointers or devices in the illegal possession of minors shall be immediately confiscated as contraband. (d) Business licensees who distribute, sell or exchange laser pointers or devices to minors are subject to the suspension and definitive revocation of their business licenses.§ 16-54. Prohibited Uses; Exceptions. (a) It is unlawful for a person to distribute, sell or exchange laser pointers or devices to adults, except under the following conditions:—– (1) Any distribution of a laser pointer or device shall be verified by the technical specifications of the manufacturer or distributor, which confirm that the pointer or device does not exceed 1 milliwatt. and proof of performance according to technical specifications that must be maintained by the concessionaire to be available at the request of law enforcement authorities. It is the dealer`s responsibility to obtain evidence from the seller/wholesale seller. Laser pointers or devices offered for distribution, sale or barter that do not have adequate evidence of power restrictions are subject to immediate seizure as contraband. Laser pointers and devices offered for sale in their original unopened packaging, which confirms that the devices have a power of 1 milliwatt or less, are sufficient evidence of compliance. If the distribution, sale or barter is greater than 1 milliwatt, a statement of their restrictions on use set forth in this section must be accompanied by written confirmation by Buyer of the exception(s) applicable to the possession and use of such laser pointer or device.—– (2) Any distribution, sale or exchange of an individual pointer or laser device shall be removed from written warnings for use in as long as is required herein, as well as a signed customer receipt stating that usage warnings have been provided in connection with the distribution, sale or exchange. After verifying the customer`s adult status, the merchant will ask the customer to sign under the legible printed name confirming that the warning has been given and read. b) WARNINGS OF USE REQUIRED.
