The City of Markham conducted a comprehensive review of its zoning laws and existing zoning framework. Markham has 46 different “super-ordered” zoning laws that apply to different geographic areas of the city. These comprehensive zoning by-laws were adopted between 1954 and 2004. City by-laws must be updated to comply with the City`s 2014 Official Plan, the Regional Municipality of York`s Official Plan, provincial plans and guidelines, and the Planning Act. Zoning has been applied on the basis of a number of areas proposed in the statutes and may change due to changes in policy. In addition, staff met with several developers and architects with construction experience in established Markham neighbourhoods to better understand emerging development trends in the housing sector and the current challenges facing these groups. The report stated that staff would hold three (3) non-statutory public community information days and information meetings in July 2021. These meetings were held virtually via Zoom videoconference. The intention of these meetings was to provide additional information and field issues from the public. For the sake of understanding, different levels have been included in the design map to display unique policy instances.

The zoning of land within the city also needed to be reviewed and updated due to its age and many inconsistencies in terms of definitions, permitted uses and development standards. In addition, the large number of minor changes and deviations approved over time to facilitate development created a variety of site-specific standards that merited consideration. Staff will submit a recommended statute to the DSC for consideration, which may then submit the draft statute with any proposed amendments to the Council for adoption. Exceptions to Site-Specific By-laws – Lands subject to zoning amendments passed under Official Plan 2014. Site-specific exceptions are being developed to advance these areas. The city is required to hold a public meeting required by law before the adoption of the by-laws. A full version of the updated regulations, including the proposed exceptions and mapping, will be made available to the public prior to the public meeting required by law.

No preliminary date is planned at this time. Approved by the Committee on Development Services on 14 June 2016. Each meeting was recorded for future reference and, or to give anyone who was unable to attend any of the meetings the opportunity to review the presentation and listen to what was discussed. As approved on June 7, 2021, the Development Services Committee planned to organize a workshop for Council members. The CDI workshop provided an opportunity for committee members to discuss in more detail various provisions and standards of the proposed legislation. This workshop took place on December 13, 2021. The feedback that employees and their advisor received at the open house led to further reviews and changes in several areas of the bylaws. To further explore other options, staff held extensive meetings with representatives of several housing taxpayer associations. An information report, a zoning bill and a presentation were placed on the agenda of the Development Services Committee (DTA) on June 7, 2021. The draft Comprehensive Zoning By-law was a multi-year inter-custodian undertaking. Three teams of external consultants and their sub-consultants, specializing in zoning, official plans, mapping, GIS and transportation, were engaged during this project.

The draft zoning by-law represents the next step towards the adoption of a consolidated zoning by-law for the city and the completion of Phase 3B.
